1. Introduction and acceptance

Welcome to Benchily ("Benchily", "we", "us" or "our"), the UK-based marketplace for spare places in sport. Benchily is operated by Benchily Ltd ("the Company").

By creating an account, posting a spot, joining a spot, using Find a Pal, Find a Coach or Benchily Coaching, or otherwise accessing our website at benchily-game-on.base44.app (the "Site") and any related services (together, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Services.

These Terms apply to all users, whether you are acting as a player, organiser, pal, coach, coaching client or sports center.

2. Definitions

"Spot" means a spare place in a sporting activity that an organiser posts on Benchily for other users to join or request.

"Organiser" means the user who posts a Spot. "Player" means a user who joins or requests a Spot. "Pal" means a user who posts or responds to a Find a Pal listing. "Coach" means a user who creates a coaching profile or uses Benchily Coaching. "Client" means a user who receives coaching.

"Content" means any text, image, video, rating, review or other material you submit through the Services.

3. Eligibility

You must be at least 18 years old to use the Services. By registering, you confirm that you are 18 or over and legally able to enter into binding contracts.

You may register only one account per person and must provide accurate, current information. You are responsible for keeping your password secure and for all activity under your account.

4. Your account and verification

You can update your profile, preferred sports, home town and account type (player, coach or sports center) at any time. Sports center accounts may link to an existing SportsCenter record so that their regular booking slots and facilities are shown alongside their spots.

We may verify your identity, email or coach qualifications where required, and may suspend or remove accounts that are inaccurate, misleading or used in breach of these Terms.

5. Using the platform

Benchily helps users discover, join and fill spare places in sport. You may post Spots, browse Spots, request or instantly join Spots, message other users in-app, find a Pal, find a Coach and take part in coaching.

When you join or request a Spot, a conversation may be created with the organiser so you can agree details. Joining or requesting a Spot is an expression of interest; the actual arrangement to attend is between you and the organiser (or, for group activities, the group).

6. Spots, bookings and attendance

Benchily is a marketplace and does not itself organise, host or guarantee any sporting activity. We are not a party to any agreement between users about a Spot.

Organisers are responsible for the accuracy of their Spot details (date, time, venue, level, cost, places available) and for managing requests. Players are responsible for arriving on time and for paying any agreed cost.

Reliability scores and reviews are based on attendance and feedback. No-shows and late cancellations may affect your score and your ability to join future Spots. We may remove or hide Spots that are misleading, duplicated or cancelled.

7. Payments

Some Spots are free; others involve a cost paid at the venue, paid to the organiser, or paid online through Benchily. Where payment is made through Benchily, it is processed by our payment provider (Stripe) and subject to the provider's terms.

Any cost shown for a Spot is set by the organiser. Benchily may charge service fees on certain transactions and will display any applicable fee before you confirm payment. Refunds for online payments are handled in line with our refund policy and, where relevant, the payment provider's rules.

Coaching fees are agreed between a Coach and their Client. Benchily may facilitate messaging and plans but is not the provider of coaching services unless stated otherwise.

8. Find a Pal

Find a Pal lets you share information about yourself (age, gender, experience, goals, town and willingness to travel) and message other users before playing, one-to-one or in groups.

You are responsible for your own safety when meeting other users. Meet in public, suitable venues for your activity, tell someone where you are going, and do not share personal or financial details you are not comfortable sharing. Benchily does not vet Pals and is not responsible for the conduct of users you meet through the Service.

9. Coaching and Benchily Coaching

Find a Coach lets coaches publish profiles (qualifications, experience, specialisms, services, pricing and availability) and lets users message coaches. Benchily Coaching lets coaches manage clients, send training and nutrition plans, log weigh-ins and goals, and message clients with media.

Coaches are solely responsible for the services they provide, the accuracy of their qualifications, and the safety and suitability of any plan, exercise or nutrition advice. Clients should consult a qualified medical professional before starting any new exercise or nutrition programme.

Coaching may involve health and body data (for example weight, body fat percentage and goals). Such data is provided voluntarily and is processed as described in our Privacy Policy.

Benchily does not employ coaches and is not a party to any coaching relationship. Disputes about coaching should be raised with the coach directly.

10. Sports centers

Benchily lists sports centers and venues for discovery and may show facilities, opening hours, websites and links to book regular slots. Listings may be seeded demo data or managed by a center's own account. Benchily is not responsible for the availability or quality of third-party venues or their booking systems.

11. Acceptable use and conduct

You agree not to: post false, misleading or duplicated Spots; use the Services to harass, threaten, discriminate or deceive other users; share another person's personal data; post Content that is unlawful, harmful, hateful, sexual, or that infringes rights; attempt to bypass payments, moderation or access controls; or use automated tools to scrape or overload the Services.

We may use automated tools (including AI) to review and flag Content that may breach these Terms, and may remove, hide or report such Content. Flagged Content may be hidden from other users until reviewed.

12. Reviews, reliability and moderation

Reviews and reliability scores reflect user feedback and attendance and are provided in good faith. You must not post false or retaliatory reviews, or offer or accept incentives for reviews.

We may moderate, edit or remove reviews or Content that breach these Terms or applicable law, and may take action against accounts that repeatedly breach them.

13. Content and intellectual property

You retain ownership of your Content. By submitting it, you grant Benchily a worldwide, royalty-free licence to host, store, use, display and process that Content for the purpose of operating and improving the Services.

You confirm that your Content does not infringe the rights of any third party and that you have the necessary permissions for any images or videos you upload.

The Benchily name, logo and Site design are owned by us or our licensors and may not be used without permission.

14. Assumption of risk and full liability exclusion

Sporting activity, training, exercise and coaching all carry an inherent risk of injury, illness, death and loss. Before taking part in any sports session, training session, coaching plan, exercise or nutrition programme arranged, offered or discovered through Benchily, you must consult a qualified doctor, physician or other appropriate medical professional to confirm that you are fit to participate.

You take part in any activity entirely at your own risk and are responsible for your own health, fitness, preparation, warm-up, equipment, technique and conduct.

To the fullest extent permitted by law, Benchily, its directors, officers, employees, coaches, partners, affiliates, service providers and agents (together, "the Benchily Parties") accept no responsibility and have no liability for any injury, illness, death, disability, loss of income, loss of earnings, loss of business, loss of opportunity, loss of enjoyment, medical or rehabilitation expenses, psychological harm, or any other loss or damage of any kind whatsoever — whether direct, indirect, consequential, special, incidental or otherwise — arising out of or in connection with any sports, training, coaching, exercise or nutrition activity, plan, advice or session accessed, arranged or discovered through the Services, however caused (including, to the maximum extent permitted by law, by negligence), save only where liability cannot be excluded or limited by law.

Coaches, organisers, sports centers, pals and other users are independent third parties and not agents, partners or employees of Benchily. Benchily does not vet, guarantee or warrant their qualifications, competence, insurance, advice or conduct, and the Benchily Parties are not liable for any act or omission of any such third party, or for any injury or loss arising from your interaction with them.

Any training or nutrition plan, advice, weigh-in or goal provided through Benchily Coaching is general information only and is not a substitute for professional medical, physiotherapy or nutritional advice. You rely on it at your own risk.

By using the Services you waive, to the maximum extent permitted by law, any claim or right you might have against the Benchily Parties arising from any such injury or loss, and you accept full responsibility for all risks involved in any activity you take part in through Benchily.

15. No responsibility or insurance

Benchily holds no responsibility and has no insurance or liability for any user. We do not provide, arrange or maintain any insurance — personal, public liability, professional indemnity or otherwise — covering users, coaches, organisers, sports centers, pals or any activity arranged through the Services.

Each user is solely responsible for arranging their own appropriate insurance for their activities, and Benchily accepts no liability for any loss, injury or damage arising from any activity undertaken through the Services, to the fullest extent permitted by law.

16. Indemnity

You agree to indemnify and hold us harmless from any claims, losses or damages arising from your Content, your breach of these Terms, or your use of the Services, including claims from other users or third parties.

17. Reports and disputes between users

You can report users, Spots or Content that you believe breach these Terms. We will review reports and may take action, but we do not mediate disputes between users. If you have a dispute with another user, you resolve it directly with them (or, for coaching, with the coach).

18. Changes to the Services and these Terms

We may update or change the Services at any time. We may update these Terms from time to time and will show the last-updated date above. Continued use of the Services after a change means you accept the updated Terms.

19. Suspension and termination

You can delete your account or stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, if your account is inactive, or to protect the safety or integrity of the Services.

20. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any dispute arising from them or the Services that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of England and Wales.
